Privacy Policy

Ecomplicity Labs FZC(“PassPunch”, “we”, “our”) operates passpunch.com and the PassPunch mobile application. This Privacy Policy explains how we collect, use, and protect your information.

1. Information We Collect

Business accounts

  • Name, email address, and phone number
  • Business name, address, and type
  • Billing information — processed by our payment provider; we never store card details
  • Usage data: stamps issued, campaigns sent, dashboard activity

Customer accounts

  • Name and email address
  • Loyalty activity: stamps earned, rewards redeemed, businesses enrolled
  • Device information for push notification delivery

Automatically collected

  • IP address and approximate location
  • Browser type and referring URLs (website only)
  • Log data and error reports

2. How We Use Your Information

  • To create and manage your account
  • To deliver stamps, notifications, and rewards
  • To process payments and send invoices
  • To provide customer support
  • To send product updates (opt-out available)
  • To detect fraud and ensure platform security
  • To comply with UAE law

3. Data Sharing

We never sell, rent, or trade your personal data. We share data only with:

  • Service providers — infrastructure, payments, email delivery partners operating under data processing agreements.
  • Business–customer relationship — when a customer joins your programme, their name and stamp activity are visible to that business only.
  • Legal obligations — when required by UAE law or court order.

4. Data Storage & Security

Data is stored on Google Cloud Platform (Middle East / EU regions). All data is encrypted in transit (TLS 1.2+) and at rest. Access is restricted to authorised personnel on a need-to-know basis.

5. Data Retention

Account data is kept while your account is active, plus 90 days after closure. Billing records are retained 7 years per UAE commercial law requirements.

6. Your Rights

You may at any time: access a copy of your data, correct inaccuracies, request deletion, opt out of marketing, or request a data export. Email legal@passpunch.com — we respond within 30 days.

7. Cookies

We use essential cookies for authentication and optional analytics cookies. Optional cookies can be disabled via browser settings without affecting core functionality.

8. Children

Our services are not directed to children under 13. Contact us at legal@passpunch.com if you believe we have inadvertently collected such data and we will delete it promptly.

Terms of Service

By accessing or using PassPunch (the “Service”) you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

PassPunch provides a digital loyalty programme platform including QR/NFC stamping, push notification campaigns, analytics, and related features. Ecomplicity Labs FZC may modify or discontinue features with reasonable notice.

2. Account Registration

  • You must be at least 18 years old and authorised to represent the business you register.
  • You are responsible for keeping your login credentials confidential.
  • Notify us immediately at legal@passpunch.com if you suspect unauthorised access.

3. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of UAE law
  • Issue fraudulent stamps or manipulate loyalty balances
  • Harvest or export customer data for purposes outside PassPunch
  • Reverse-engineer, decompile, or copy any part of the platform
  • Send spam or misleading push notifications to customers
  • Resell or white-label the Service without written agreement

Violations may result in immediate account suspension without refund.

4. Payments & Billing

  • Paid plans are billed monthly or annually in advance.
  • All prices are in USD, exclusive of applicable taxes.
  • Failed payments trigger a 7-day grace period before downgrade to Free.
  • We do not store payment card data; billing is handled by our PCI-compliant payment provider.

5. Data Ownership

You own your business data and your customers' loyalty data. We process it on your behalf as a data processor. Upon termination you may request a full export within 30 days.

6. Intellectual Property

PassPunch and all associated trademarks, software, and content are owned by Ecomplicity Labs FZC. You retain ownership of your brand assets uploaded to the platform.

7. Uptime

We target 99.5% monthly uptime for paid plans. Unplanned downtime exceeding 2 hours in a calendar month entitles paid customers to a pro-rata service credit upon request.

8. Limitation of Liability

To the maximum extent permitted by UAE law, Ecomplicity Labs FZC's total liability for any claim shall not exceed the fees you paid in the three months preceding the claim. We are not liable for indirect or consequential damages.

9. Governing Law

These Terms are governed by the laws of the UAE. Disputes shall first be addressed through good-faith negotiation; if unresolved, they shall be submitted to the courts of Sharjah, UAE.

Refund Policy

We want you to be confident trying PassPunch. This policy explains when and how refunds are issued.

1. Free Plan

The Free plan has no cost, so no refund applies.

2. 30-Day Money-Back Guarantee

If you are on a paid plan (Growth or Pro) and are not satisfied for any reason, you may request a full refund within 30 days of your first payment or most recent annual renewal. Email legal@passpunch.com from your account address. We process approved refunds within 5–10 business days to your original payment method.

3. After 30 Days

Refunds are not issued after the 30-day window. You may cancel at any time and retain access until the end of the current billing period — you will not be charged again.

4. Exceptions — No Refund If

  • Your account was suspended for Terms of Service violations
  • The request is for a plan purchased more than 30 days ago
  • A refund has already been issued for the same billing period

5. Annual Plans

Annual plans qualify for the 30-day money-back guarantee from purchase or renewal date. Partial refunds for unused months beyond 30 days are not issued; however, you may downgrade to Free at any time.

6. Service Credits

If unplanned downtime exceeds our uptime commitment, eligible customers may request a pro-rata service credit applied to the next billing cycle.
